Among the death penalty cases coming out of the 1993 uprising at the Southern Ohio Correctional Facility in Lucasville, the case of Keith LaMar (Bomani Shakur) is the most advanced. It is in the United States Court of Appeals for the Sixth Circuit. A panel of three judges will hear oral argument. One, Judge Clay, is an African American who has written strong opinions about "discovery," Keith's main issue. More details, including the legal documents are online here.
We're awaiting the court to schedule the oral argument for this appeal. The oral arguments will occur in the Potter Stewart US Courthouse in Cincinnati. Keith is not allowed to be present at the oral argument and is counting on us to demonstrate that he is not alone, we are all watching.
Next steps in the legal procedure...
The 6th Circuit is the last stage in the federal appeals process before the US Supreme Court. After the opinion on the oral argument, the defence or the prosecution can appeal the decision of the 3 judge panel to an EN BANC reconsideration by all of the Sixth Circuit judges. Then it can be appealed to the US Supreme Court.
If the 6th Circuit or the US Supreme Court decide in our favor, the case will be remanded to state courts, and possibly retried.
If those appeals do not go in our favor, the Supreme Court of Ohio will set an execution date for Keith. Then Keith's only chance would be clemency from either the Ohio Adult Parole Board or the Governor of Ohio.
How to support...As soon as we have dates for the oral argument we'll be doing everything we can to pack the court house. If you are in Ohio or otherwise near Cincinnati, please consider organizing a caravan or car pools to bring folks from your community to court. If you are in Cincinnati, please help organize housing, food, convergence space and other infrastructure for this gathering.
